License to Cross

All License to Cross (LTC) applications and agreements shall adhere to New Jersey Administrative Code, Title 19, Chapter 9, Subchapter 5 (NJAC 19:9-5) (link ). 

License to Cross Definition (NJAC 19:9-5.2(a)): 

(a) A license to cross is a formal agreement with the Authority granting permission to enter upon or access the Roadway or other Authority property. This access pertains to public and private utilities that must occupy the property under, on, or over the Roadway in order to provide service to the public. 

License to Cross Application Fee (NJAC 19:9-5.3(b)): 

(b) Application Fee. A minimum application fee of $ 6,000* shall be submitted along with the completed license application and associated documents. Such fee shall be non-refundable, whether the Authority’s final decision is to issue or deny the required license. The application fee shall be renewed, and another $ 6,000 application fee shall be paid, if there is a six-month period of application inactivity caused by the applicant. A period of inactivity shall be defined as the time lapsed between written correspondence regarding the application. 

*Stated application fee is current as of February 3, 2025. Applicant is directed to N.J.A.C. 19:9-5.3(b) for the most up to date fee amount. 

The Standard LTC Agreement  contains the usual terms and conditions for an LTC, including provisions on the term, costs, insurance and indemnification.

It is recommended that the LTC application package be submitted to the Authority as soon as preliminary plans are developed by the Applicant for the project. Requests for changes to the standard requirements are not usually granted and may delay the overall LTC process. 

The LTC application package including LTC Application form, LTC Checklist , plans, specifications, and other supporting documentation (examples: system maps, GIS info, etc.) shall be submitted directly to the attention of the Engineering Department. A non-refundable application fee in the amount stated in NJAC 19:9-5.3(b) shall be provided in the form of a certified check or money order payable to the New Jersey Turnpike Authority and submitted with the LTC application package. 

All documents shall be submitted in electronic format in accordance with the LTC Checklist along with two (2) hardcopies of the entire LTC application package.
